These Terms of Service (“Terms”) govern your access to and use of cendoriq.com, any related online services, and purchases made through them (collectively, the “Site”). By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
1. About Cendoriq
Cendoriq is an independent e-commerce retailer operated by Cendoriq. We offer professional aesthetic consumables, skincare and beauty products, treatment accessories, cartridges, tips, solutions, and related supplies. We may offer products from multiple manufacturers and brands.
2. Eligibility and Customer Responsibilities
You represent that you are at least the age of majority in your jurisdiction and may form a binding agreement. You are responsible for providing complete, current, and accurate account, payment, shipping, and contact information. You are also responsible for confirming, before purchase, that a product is lawful to import, possess, purchase, and use at your delivery location and is suitable for your intended use.
Some products may be labeled or intended for professional use. You must use those products only in accordance with the manufacturer’s instructions, labeling, warnings, applicable law, and any qualifications or supervision required where you use them. Cendoriq does not provide medical diagnosis, individualized medical treatment advice, or professional training unless expressly stated in writing.
3. Product Information, Brand References, and Variations
We aim to present product descriptions, specifications, and images accurately. However, product photos, packaging, labeling, lot numbers, expiration dates, colors, designs, and other details may vary by manufacturer, production batch, or product update. Product images are illustrative unless a description expressly states otherwise.
When applicable, product descriptions identify the manufacturer or brand. Third-party names, logos, trademarks, and trade dress are the property of their respective owners and are used only to identify the relevant products or brands. Their use does not imply sponsorship, affiliation, or endorsement of Cendoriq unless expressly stated.
4. Orders, Availability, Pricing, and Acceptance
Submitting an order is an offer to buy the products listed in your order. An order confirmation does not mean that we have accepted the order. We accept an order when we ship it, send a separate acceptance notice, or otherwise clearly confirm acceptance.
Products are subject to availability. We may correct typographical errors, pricing errors, product-description errors, or inventory inaccuracies. To the extent permitted by law, we may limit quantities, decline or cancel an order, or issue a refund when reasonably necessary because of an inventory issue, payment problem, suspected fraud, incorrect pricing, legal or compliance concern, or another legitimate business reason. If we cancel an order after payment has been captured, we will issue the applicable refund in accordance with our policies and applicable law.
5. Payment, Shipping, Returns, and Cancellations
Your purchase is subject to our Payment Policy, Shipping Policy, Return and Refund Policy, Cancellation Policy, and International Shipping, Customs, Duties, and Taxes Policy, each of which is incorporated into these Terms. Estimated delivery dates are estimates unless you purchase a service expressly identified as guaranteed. Nothing in these Terms limits any shipping-delay, cancellation, refund, or other consumer right that cannot lawfully be waived.
6. Acceptable Use
You may use the Site only for lawful personal or business purchasing purposes. You may not interfere with the Site; attempt unauthorized access; introduce malware; use automated means to scrape or overload the Site without our written permission; impersonate another person; submit false information; use the Site to commit fraud; or violate applicable laws or third-party rights.
7. Intellectual Property
The Site and its original content, design, text, graphics, photographs, software, and other materials are owned by or licensed to Cendoriq and are protected by applicable intellectual-property laws. 8. Third-Party Services and Links
The Site may contain links to, integrations with, or services provided by third parties, including payment processors, shipping carriers, manufacturers, and social-media platforms. Those third parties control their own content, terms, and privacy practices. We are not responsible for third-party sites or services except to the extent required by law.
9. Disclaimers
Except where a written warranty is expressly provided or applicable law requires otherwise, products and the Site are provided on an “as available” basis. Product-specific information, manufacturer instructions, and labeling should be reviewed before use. Nothing in these Terms excludes or limits warranties, remedies, or consumer protections that cannot lawfully be excluded or limited. 10. Limitation of Liability
Our Limitation of Liability is incorporated into these Terms. It does not exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cendoriq and its officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, and expenses arising from your unlawful use of the Site, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or legal obligations that cannot be disclaimed.
12. Governing Law and Venue
These Terms are governed by the laws of New Jersey, without regard to conflict-of-law rules, except where the laws of your place of residence provide protections that cannot be waived. Any court proceeding must be brought in a court of competent jurisdiction in New Jersey, unless applicable law requires another forum. We do not require arbitration or a class-action waiver under this draft; any such clause should be added only after legal review.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last Updated” date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Site after the effective date of an update means you accept the updated Terms.
